TERMS OF SERVICE — SNOOZE NOOK

OVERVIEW
Welcome to Snooze Nook. Our website, www.snoozenook.co.za, is operated by Nicala Kruger, a sole proprietor trading as Snooze Nook. References to “we”, “us” and “our” mean Nicala Kruger trading as Snooze Nook.
We sell baby nursery and sleep products within South Africa. We deliver nationwide within South Africa and do not offer international sales or delivery.
Our store is powered by Shopify. These Terms of Service (“Terms”) govern your use of our website and purchases from our store, together with the order details and policies expressly referenced below.
Please read these Terms before placing an order. By placing an order, you agree to the Terms made available to you at checkout.
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded under South African law, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).
These statutory protections take precedence over conflicting wording in these Terms or our other policies, including provisions concerning Shopify.
1. ACCESS AND CUSTOMER ACCOUNTS
To place an order independently, you must be at least 18 years old and legally capable of entering into an agreement. A person under 18 may purchase only with the necessary assistance of a parent or legal guardian.
You must provide accurate and current contact, payment and delivery information. Please notify us promptly of errors that could affect your order.
If you create an account, keep your login details confidential and notify us if you suspect unauthorised access.
You may not use another person’s account or payment method without permission.
2. PRODUCTS AND PRODUCT INFORMATION
We take reasonable care to describe and display our products accurately.
Please review product descriptions, dimensions, materials, age or weight restrictions, care instructions and safety warnings before purchasing. Contact us if you need clarification.
Screen settings may cause minor colour differences. This does not affect your rights where goods materially differ from their description.
Follow the manufacturer’s assembly, use, supervision and maintenance instructions. Stop using a product that appears damaged or unsafe and contact us for assistance. These responsibilities do not remove our obligations concerning product quality and safety.
We source products from suppliers, receive them ourselves and then dispatch them to customers. Supplier involvement does not remove our responsibilities as the seller.
We may update listings or discontinue products for future purchases. We will not change the agreed specifications of an existing order or substitute an item without your consent.
3. ORDERS AND ACCEPTANCE
Before submitting your order, you may review your selection, correct errors or leave the checkout.
Placing an order is an offer to purchase. An automated acknowledgement confirms receipt of your order. Acceptance occurs when we expressly confirm acceptance or dispatch the goods, whichever happens first.
Payment must be successfully processed before dispatch.
We may decline an order on reasonable grounds, including unsuccessful payment, suspected fraud, unavailable stock or a delivery address outside South Africa.
If we cannot fulfil an order, we will notify you and refund the relevant payment within the applicable legal period. Any additional rights or remedies available under law remain unaffected.
We will not substitute products or increase an agreed price without your consent.
4. PRICES AND PAYMENTS
All prices are displayed in South African rand (ZAR).
Snooze Nook is currently not VAT registered and does not separately charge VAT.
Payments are processed through Yoco using the payment methods available at checkout. You must be authorised to use your selected payment method.
The total payable, including any delivery charge, will be displayed before you confirm your order.
Price changes apply to future orders. If we discover a pricing error affecting an order, we will contact you and resolve it in accordance with applicable law. We will not charge an additional amount without your agreement.
Promotional conditions will be disclosed with the relevant offer and cannot override statutory consumer rights.
5. DISPATCH, SHIPPING AND DELIVERY
We deliver nationwide within South Africa only.
Orders are dispatched within three business days after successful payment, unless a different dispatch period is clearly disclosed and agreed before purchase. Business days exclude Saturdays, Sundays and South African public holidays.
Dispatch means that your parcel has been handed to the courier. Courier transit time is additional.

Delivery costs R80 for orders with a product subtotal below R500. Delivery is free for orders with a product subtotal of R500 or more.
The qualifying subtotal is calculated after discounts and excludes delivery charges. The applicable delivery charge will be shown before payment.
We will notify you of material delays. Delivery estimates do not remove our obligations concerning agreed delivery arrangements or your remedies for late delivery.
Unless a different period is agreed, orders must be fulfilled within 30 days of receipt. Where ECTA applies and we miss that period or the agreed period, you may cancel on seven days’ written notice, without losing any other applicable rights.
If goods become unavailable, we will notify you immediately and refund payments within 30 days of that notification, or sooner where required by law.
Goods remain at our risk until you or your authorised recipient accepts delivery. Handing a parcel to the courier does not transfer that risk to you.
Please provide a complete and accurate delivery address. Any reasonable additional delivery charge resulting from incorrect details or a missed agreed delivery will be explained and agreed before redelivery.
6. ORDER CHANGES AND CANCELLATIONS
Contact sales@snoozenook.co.za as soon as possible if you wish to change or cancel an order.
If your order has already been dispatched, it may need to be handled through the return process. Dispatch does not remove statutory cancellation or return rights.
Where ECTA’s cooling-off right applies, you may cancel without reason or penalty within seven days after receiving the goods. Only the direct cost of returning the goods may be charged, and payments must be refunded within 30 days of cancellation.
Statutory exceptions to the cooling-off right apply where relevant. Other cancellation rights available under South African law remain unaffected.
7. OUR VOLUNTARY 30-DAY RETURN POLICY
We offer a voluntary 30-day return period, calculated from the date you receive your item, during which you may request a qualifying change-of-mind return.
For these voluntary returns:

The item must be unused or unworn and in the same condition in which you received it.

Tags and original packaging must be included.

You must provide a receipt or other proof of purchase.

You are responsible for the return delivery cost.

Sale items and gift cards are excluded from voluntary change-of-mind returns, subject to applicable law.
To request a return, contact sales@snoozenook.co.za. We will provide instructions on how and where to send the item.
If we arrange a return shipping label, we will explain its cost and obtain your agreement before providing it.
Please contact us before sending goods back so we can arrange their receipt. Failure to obtain advance approval does not extinguish a statutory return right.
These voluntary conditions do not restrict statutory cooling-off rights or remedies for defective, unsafe, damaged, incorrect or misdescribed goods.

If that policy conflicts with the statutory protections or express return commitments in these Terms, those protections and commitments take precedence.
8. DAMAGED, DEFECTIVE OR INCORRECT GOODS
Please inspect your order on receipt and contact us as soon as reasonably possible if an item is damaged, defective, unsafe or incorrect. Include your order details and a description of the problem.
Failure to report an issue immediately does not automatically invalidate a lawful claim.
Where goods fail to meet the CPA’s applicable quality standards, you may return them within six months of delivery, without penalty and at our risk and expense, and choose a repair, replacement or refund, subject to the Act.
Where goods are repaired and, within three months after that repair, the failure, defect or unsafe feature has not been remedied or a further failure, defect or unsafe feature is discovered, the CPA provides further replacement or refund rights.
Our unused-item, original-packaging and sale-item conditions for voluntary returns do not override these rights. Other statutory remedies remain available.
We will cover reasonable return delivery costs for incorrect, damaged or defective goods where required by law. Contact us so we can arrange an appropriate return method.
9. REFUNDS AND EXCHANGES
For voluntary returns, we will inspect the returned item and notify you whether it meets the disclosed return conditions. If we decline a voluntary return, we will explain the reason.
Approved voluntary refunds will be processed to the original payment method within 10 business days. Any applicable statutory refund deadline takes precedence and will not be extended by our internal approval process.
Your bank or payment provider may take additional time to display a processed refund. Contact sales@snoozenook.co.za if you have not received an expected refund.
For a voluntary exchange, contact us to arrange a qualifying return and place a separate order for the replacement item.
This process does not limit a statutory right to a replacement or require you to make a new purchase to obtain a statutory remedy.
10. PRIVACY AND COOKIES
We process personal information in accordance with applicable South African data protection law, including the Protection of Personal Information Act 4 of 2013 (“POPIA”).
Our Privacy Policy explains how we collect, use, share, retain and protect personal information, including through Shopify, Yoco and advertising integrations.

You can manage optional tracking choices through the cookie banner and cookie-preferences controls on our website.
Agreeing to these Terms or making a purchase does not, by itself, constitute consent to optional advertising tracking or promotional communications where separate consent is required.
11. RELATIONSHIP WITH SHOPIFY
Snooze Nook is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Snooze Nook. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Snooze Nook, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Snooze Nook.
For this section, “Services” means our store, website and related services. The statutory-rights protections in the Overview apply to this section, including its release of claims.
12. INTELLECTUAL PROPERTY
Website content, branding, photographs, text and designs belong to Snooze Nook or their respective owners and are protected by applicable intellectual property laws.
You may browse our website and save or print information relating to your purchases and these Terms for personal reference.
You may not copy, distribute or commercially exploit protected content without permission, except where permitted by law.
Third-party names, logos and trademarks remain the property of their respective owners.
13. REVIEWS AND FEEDBACK
If you submit a review or other content for publication, you confirm that it reflects your honest experience and that you have the necessary rights to submit it.
You grant us a non-exclusive, royalty-free licence to display and reproduce that content in connection with our store and its promotion, subject to applicable privacy law. You retain ownership of your content.
We may make minor formatting changes without changing its meaning. We may remove unlawful, misleading, abusive or infringing content.
Private customer service correspondence is not treated as permission to publish a testimonial.
Please do not include children’s personal information or photographs in reviews or other submissions.
14. THIRD-PARTY TOOLS AND LINKS
Our website may include third-party tools or links. Separate terms and privacy notices may apply when you use independent third-party services.
A link does not necessarily mean that we endorse the linked website. Responsibility for independent third-party content is determined by applicable law.
Our use of payment processors, couriers or other service providers does not remove our responsibilities to you as the seller.
15. ACCEPTABLE USE
You must not use our website to:

Commit fraud or provide deliberately misleading information.

Infringe intellectual property or privacy rights.

Harass, threaten or unlawfully harm another person.

Distribute malicious software or interfere with website security.

Access accounts or systems without authorisation.

We may restrict access where reasonably necessary to address misuse or protect the website and its users.
16. WEBSITE INFORMATION AND AVAILABILITY
We take reasonable steps to keep our website accurate and available but cannot promise uninterrupted or error-free access.
We may correct errors or update website information. Where an error affects an existing order, we will contact you and resolve it fairly and in accordance with applicable law.
General website information does not replace product-specific instructions or professional advice where needed.
Nothing in this section excludes statutory product warranties, excuses misleading descriptions or gives us an unrestricted right to cancel accepted orders.
17. LIABILITY
Nothing in these Terms excludes or limits liability for fraud, gross negligence, liability imposed by applicable product safety law, or any other liability that cannot legally be excluded or limited.
Our responsibility for loss or damage is determined by applicable law.
You are not required to waive lawful claims merely by browsing our website or purchasing a product.
18. SUSPENSION AND TERMINATION
We may suspend or terminate website or account access for a material breach of these Terms, unlawful conduct or a genuine security risk.
Where reasonable, we will notify you and allow an opportunity to resolve the issue. Immediate action may be necessary in cases of fraud or security threats.
Closing an account does not remove your rights relating to existing orders, refunds, warranties or complaints, or our corresponding obligations.
19. SOUTH AFRICAN LAW AND COMPLAINTS
These Terms and purchases from Snooze Nook are governed by South African law.
Please send complaints to sales@snoozenook.co.za, including your order number and a description of the issue.
You retain the right to approach an appropriate ombud, regulator, tribunal or court with jurisdiction, using the procedures provided by law.
Nothing in these Terms requires you to bring a claim exclusively in Gqeberha or prevents you from exercising statutory complaint rights.
20. GENERAL TERMS
These Terms, the order details agreed at checkout and the policies expressly incorporated into them govern your purchase and use of the store. They do not exclude binding representations or protections recognised by law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent that they can operate lawfully.
A delay in exercising a right does not automatically waive that right.
Any transfer of our rights or obligations must comply with law and must not unlawfully reduce your consumer protections.
You may save or print these Terms for your records.
21. CHANGES TO THESE TERMS
We may update these Terms and will display the revised date on this page. Material changes will be communicated where required by law.
Changes apply prospectively and will not retrospectively reduce your rights under an existing order without your lawful agreement.
